For all industrial property rights such as patents, utility models, trademarks and designs, application documents defining the subject matter to be protected must be prepared and submitted. Amendments and additions to these application documents are only possible in a highly restrictive manner, which is why the application documents should be prepared with the utmost care and with a long-term perspective.
Official procedure forobtaining property rights
The application documents are used as the basis for filing with the German Patent and Trademark Office (DPMA) or other offices, depending on the type of property right. If only a registration is made after a formal examination, as in the case of utility models and designs, a corresponding notification can be expected soon. If the patentability of a patent or the absolute grounds for refusal of a trademark are examined and the competent office has doubts about this, it is necessary to discuss the matter with the office and, if necessary, to amend the request for protection in order to obtain the grant or registration.
